Beta Test Program Addendum

This Beta Test Program Addendum ("Addendum") applies to your participation in the Zee Business Beta Testing Program (the "Program"). This Addendum supplements the Zee Business standard Terms of Service and Privacy Policy. In the event of a conflict between the standard Terms and this Addendum, this Addendum shall prevail regarding your participation in the Program.

1. Purpose of Data Collection

By joining this Program, you acknowledge that the Beta Services are intended for testing and evaluation. To facilitate this, Company collects and processes:

  1. Identifiers: Your primary phone number and email address for account verification and communication.
  2. Usage Analytics: Data regarding how you interact with the features, click-paths, and session duration.
  3. Feedback: Any responses, screenshots, or suggestions provided via testing forms.

2. Disclosure of Third-Party Integrations

To improve the user experience and analyse Program performance, Company utilizes specific third-party service providers. By participating, you provide express consent for the following data sharing:

  1. Mixpanel, Inc.: Your identifiers and behavioural data will be shared with Mixpanel for real-time product analytics and event tracking.
  2. Tally B.V. (Tally.so): Your feedback and form responses are processed and stored via Tally’s secure infrastructure.
  3. Cross-Border Transfers: You acknowledge that your data may be processed on servers located in the United States or other jurisdictions necessary to facilitate these third-party services.

3. Beta "As-Is" Status & Liability

The Program features are "pre-release" and may contain bugs, errors, or service interruptions.

  1. No Warranty: THE BETA SERVICES ARE PROVIDED "AS-IS" AND "AS-AVAILABLE." COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  2. Limitation of Liability: To the maximum extent permitted by applicable law, Company’s total liability for any claims arising from the Program shall not exceed $100.00 USD. IN NO EVENT SHALL COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

4. Confidentiality & Intellectual Property

The features, designs, and UI/UX of the Program are the Confidential Information of the Company. You agree not to disclose, screenshot, record, publicly share, or otherwise reveal details of the "Cool New Features" (or any other aspect of the Beta Services) to any third party until the official public launch.

All feedback provided, including any ideas, suggestions, modifications, improvements, or derivative works arising from or related to your participation in the Program (collectively, "Feedback"), becomes the sole property of the Company. You hereby irrevocably assign to Company all right, title, and interest in and to such Feedback, including all intellectual property rights therein, and agree to execute any further documents reasonably requested by Company to perfect such assignment.

You further agree not to (and not to allow any third party to):

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code, structure, or ideas underlying the Beta Services.
  • Modify, create derivative works of, or translate the Beta Services.
  • Use the Beta Services for any purpose other than personal, non-commercial beta testing and providing Feedback.
  • Remove, obscure, or alter any proprietary notices on the Beta Services.

5. US Consumer Privacy Rights

Residents of certain US states (including CA, VA, CO, and CT) may have rights regarding the access or deletion of their personal data. To exercise these rights, please contact [Insert Support Email].

Note that requesting data deletion may result in your immediate removal from the Program. Company will process such requests in accordance with applicable US state privacy laws and as detailed in the main Privacy Policy.

6. Termination

Company reserves the right to terminate the Program or your individual access at any time without prior notice. Your data will be retained for the duration of the testing phase and for a reasonable period thereafter to implement product improvements, after which it will be deleted or anonymized in accordance with the main Privacy Policy.

7. Miscellaneous

This Addendum represents the entire agreement between the parties regarding the Program and supersedes all prior discussions or agreements. If any provision of this Addendum is found to be unenforceable, the remaining provisions will remain in full force and effect.

This Addendum is governed by the laws of the State of Nevada, USA, without regard to conflict of law principles.

You represent and warrant that:

  • You are participating in the Program solely for personal, non-commercial purposes.
  • You are not employed by, consulting for, or otherwise affiliated with any competitor of Company or any entity developing competing products/services.
  • You will comply with all applicable US export control laws and regulations and will not export, re-export, or transfer the Beta Services in violation thereof.

8. Acceptance of Terms

By clicking "Join," registering for an account, or otherwise using the Beta Services, you acknowledge that you have read, understood, and agree to be bound by this Addendum and the underlying Governing Agreements.
